Terms & Conditions
Evotech Software — operated by EVOTECHCORP LTD EOOD
Effective date: 1 September 2026
Last updated: 10 October 2026
Please read these Terms & Conditions ("Terms") carefully. By using https://evotechcorp.io (the "Website"), our estimator app for iOS and Android (the "App"), or our booking calendar, or by requesting our services, you agree to these Terms.
1. Who we are
The Website and the App are operated by EVOTECHCORP LTD EOOD, trading as Evotech Software ("Evotech", "we", "us"), ul. Maragidik No. 19, fl. 2, ap. office 1, Burgas 8000, Bulgaria. Email: [email protected].
"You" means the person using the Website or the App, or the company or person requesting or buying our services ("Client").
2. Scope of the Website and our services
The Website presents our services and lets you contact us, submit a project intake request, book a call, and access the client portal if we have registered you. We offer:
- mobile app development for iOS and Android, built from the Client's designs;
- maintenance of mobile apps;
- security audits.
Our VIP forensics service is not currently offered. We do not accept requests or payments for it.
Content on the Website (including descriptions, timelines and prices) is general information. It is not an offer that becomes a contract when you submit a form. A contract exists only as described in section 3.
3. Project agreements prevail
All project work is governed by a separate written agreement, proposal or statement of work ("Project Agreement") signed or accepted in writing by the Client and us. The Project Agreement defines the scope, deliverables, timeline, fees, payment terms, acceptance and intellectual property.
If these Terms conflict with a Project Agreement, the Project Agreement prevails. These Terms apply to anything the Project Agreement does not cover.
4. Quotes and estimates
- Prices shown on the Website are starting references and may change after we review your project.
- Estimates produced by the App or on the Website are automatic, rule-based indications. They are not binding and do not create a contract or an obligation to perform work at that price.
- A price is binding only when stated in a Project Agreement or written quote that we have confirmed.
- Where the Website mentions a refundable evaluation deposit, its amount, payment method and the conditions for refunding it or deducting it from the project total will be confirmed to you in writing before any payment is made.
5. Bookings
- Calls are booked through a calendar provided by a third-party scheduling provider. Booking a call does not create an obligation for either party to enter into a contract.
- Please give accurate contact details and attend on time. If you cannot attend, cancel or reschedule using the link in your booking confirmation or by emailing us, if possible at least 24 hours in advance.
- We may reschedule or cancel a call if necessary and will tell you as soon as possible.
- Initial calls are free of charge unless we tell you otherwise in writing.
6. Client obligations
You agree to:
- give accurate, complete and up-to-date information;
- provide the materials we need on time, including, for app development, an editable, development-ready Figma file;
- grant access to your accounts and systems only through delegated access (for example developer team invitations or project roles). We do not ask for your master passwords;
- pay third-party costs under your own accounts (for example Apple Developer Program, Google Play, cloud hosting and external APIs), unless the Project Agreement says otherwise;
- ensure you hold all rights and licences for the materials, content, designs and data you give us, and that our use of them for the project does not infringe third-party rights or the law;
- comply with the App Store, Google Play and other platform rules that apply to your app;
- review deliverables and give feedback within the agreed times.
Delays caused by missing information, materials, access or feedback may change the timeline and fees.
7. Intellectual property
- Website and App: the Website, the App and their content (texts, design, logos, software) belong to us or our licensors. You may use them only to learn about and request our services. You may not copy, modify, distribute or reverse-engineer them, except where the law allows.
- Project deliverables: ownership and transfer of the source code and other deliverables are defined in the Project Agreement. Unless it states otherwise, ownership of the source code and deliverables created specifically for the Client transfers to the Client once all amounts due for the project have been paid in full. Until then, the Client may use the deliverables only for review and testing.
- Our tools and know-how: we keep all rights in our pre-existing tools, libraries, frameworks, methods and know-how, and in general improvements to them. Where such items are included in deliverables, the Client receives a non-exclusive, perpetual, worldwide licence to use, modify and maintain them as part of the deliverables.
- Third-party and open-source components remain subject to their own licences.
- Portfolio: we will not name the Client or show the project in our portfolio without the Client's prior written consent.
8. Confidentiality
Each party will keep confidential any non-public information received from the other in connection with a project, use it only for that project, and disclose it only to staff and subcontractors who need it and are bound by similar obligations. This does not apply to information that is public, already known to the recipient, independently developed, or that must be disclosed by law or court order. These obligations continue after the project ends for 3 years. A separate non-disclosure agreement or Project Agreement prevails over this section.
9. Security audit authorisation
- We perform security audits and any testing only on systems, applications, devices and accounts that the Client owns or is legally authorised to test.
- Before testing starts, the Client must give written authorisation that defines the scope, targets, methods and time window, and confirm it has authority to grant it, including any approvals needed from hosting providers or other third parties.
- We will not test anything outside the agreed scope. The Client is responsible for the accuracy of the scope it provides and for informing affected parties where required.
- Testing may cause disruption, slowdowns or data changes. The Client must keep current backups and inform us of any fragile or critical systems.
- Audit findings reflect the systems at the time of testing. An audit does not guarantee that a system is free of vulnerabilities.
10. Disclaimers
- The Website and the App are provided "as is" and "as available". We aim to keep information accurate but do not guarantee that the Website or the App will be uninterrupted, error-free or always up to date.
- Unless the Project Agreement says otherwise, we do not guarantee that an app will be approved by Apple, Google or any other platform, or that it will achieve any particular commercial result.
- Nothing in these Terms limits warranties or rights that cannot be excluded under applicable law.
11. Limitation of liability
- Nothing in these Terms excludes or limits liability for intentional misconduct or gross negligence, death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
- Subject to the above, we are not liable for indirect or consequential loss, loss of profit, revenue, data or business opportunity.
- Subject to the above, our total liability arising from a project is limited to the fees paid by the Client for the specific service giving rise to the claim in the 12 months before the claim.
- Subject to the above and to the extent permitted by law, we are not liable for losses arising from use of the free Website, App or booking calendar.
- The Project Agreement may set different limits; if so, those apply.
12. Indemnity
The Client will indemnify us against third-party claims, losses and reasonable costs (including legal fees) arising from: (a) materials, content, designs or data supplied by the Client that infringe third-party rights; (b) testing performed on systems the Client represented it owned or was authorised to test; or (c) the Client's breach of these Terms or of the law. This section does not apply to consumers to the extent not permitted by law.
13. Third-party services
The Website, the App and our services use or link to third-party services, including a third-party scheduling provider (booking), Resend (email delivery), Supabase (client portal), Apple App Store, Google Play and Figma. These services are governed by their own terms and privacy policies. We are not responsible for their availability, content or practices. How we process personal data through them is explained in our Privacy Policy.
14. Termination
- You may stop using the Website and the App at any time.
- We may suspend or end your access to the Website, the App or the client portal if you breach these Terms, misuse them or create a security risk.
- Termination of a project is governed by the Project Agreement. Unless it states otherwise, either party may terminate a project by written notice if the other party materially breaches it and does not remedy the breach within 14 days of being notified. On termination, the Client pays for work performed up to the termination date, and we hand over the deliverables completed and paid for.
- Sections that by their nature should survive (including intellectual property, confidentiality, limitation of liability, indemnity and governing law) continue to apply after termination.
15. Changes to these Terms
We may update these Terms from time to time. The new version will be published on this page with a new "Last updated" date. Changes do not affect Project Agreements already signed. Continued use of the Website or the App after a change means you accept the updated Terms.
16. Governing law and courts
These Terms are governed by the laws of the Republic of Bulgaria. Any dispute will be submitted to the competent courts in Burgas, Bulgaria.
17. Consumer rights
Our services are mainly intended for businesses. If you are a consumer, nothing in these Terms removes or limits the rights you have under mandatory EU consumer law or the consumer protection law of your country of residence, including any right of withdrawal and the right to bring proceedings in the courts of your country of residence. Where a right of withdrawal applies, we will inform you about it before the contract is concluded. You can also contact the Bulgarian Commission for Consumer Protection (https://kzp.bg) about consumer disputes.
18. Other terms
If any provision of these Terms is found invalid, the rest remains in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our written consent.
